The petitioner is accused in connection with Kotwali P.S. Case No. 533 of 2016, registered under Section 30(a), 32(2), 41(I) of Bihar Prohibition and Excise Act, 2016. The accusation is that on receiving secret information about carrying of the illicit liquor by 3-4 persons in a tempo at Jamalpur road. The Police reached there and stopped the tempo. In the meantime, one person succeeded to flee away from the tempo, while three persons were apprehended. The apprehended persons disclosed their names as Md. Irfan, Karan Raj (Petitioner) and Md. Sabbir @ Bittu.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.7002 of 2017 (2) dt.08-03-2017 2/2 petitioner boarded on the tempo, as a passenger, for going to his house, but in the meantime, Police apprehended the petitioner and others. Further submission is that petitioner has no concerned with the alleged seized liquor. Further submission is that petitioner has no criminal antecedent is in custody since 11.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 533 of 2016.
