The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a)of the Bihar Prohibition and Excise Act, 2018.

Though name of the petitioner has surfaced in this case on confessional statement of co-accused and allegation is under provisions of Bihar Prohibition and Excise Act, however, the petitioner has got criminal antecedents under Bihar Prohibition and Excise Act.

Hence, in my view, this is not a fit case for grant of anticipatory bail to the petitioner in connection with Lalganj P.S.Case No.339 of 2019 pending in the court of learned

Patna High Court CR. MISC. No.26549 of 2021(2) dt.06-12-2021 2/2 Additional Sessions Judge-II-cum-Special Judge, Excise Court, Vaishali at Hajipur. Prayer is refused.

Petitioner is directed to surrender within two weeks and pray for regular bail.
