JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 The petitioner seeks regular bail in connection with NDPS Case No. 27 of 2017 arising out of Chhatauni P.S. Case No. 216 of 2016, registered for offences punishable under Sections 399, 402, 120B/34 of the Indian Penal Code and Sections 20(b), 22 of the NDPS Act.

Prosecution case is that police on secret information that miscreants are planning for dacoity, raided the rowing club of Bhawanipur Zirat and found 10 to 12 persons and on seeing the police, they started fleeing away but seven persons were apprehended and they disclosed the name of petitioner and others as the persons, who fled away and it is alleged that on search from the possession of Md. Ali, eight live cartridges were recovered and from the possession of Kunal Kumar, a country made loaded pistol and from the pocket of Vikash Kumar 200 gram of ganza was

It has been submitted on behalf of the petitioner that he has falsely been made accused in this case only on the basis of disclosure made by the apprehended person and he has remanded in this case on 06.11.2018 and since then he has been in judicial custody.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge -cum- Special Judge, Motihari, East Champaran, in connection with NDPS Case No. 27 of 2017 arising out of Chhatauni P.S. Case No. 216 of 2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
