JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 30(a)(c)(d)(e), 33 and 34(b) of the Bihar Excise Prohibition Act, 2016.

From a godown liquor was recovered and it is said that the same was of the petitioner. The petitioner was apprehended at the spot.

Submission is that the petitioner has already let-out the said godown to co-accused Pappu Kumar. The petitioner has got no criminal antecedent.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-

Patna High Court Cr.Misc. No.6666 of 2017 (5) dt.29-03-2017 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Aurangabad/Successor Court, in connection with Barun P.S. Case No. 187 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
