The petitioner seeks bail in Chapra Town P.S. Case No.334 of 2019 registered under Sections 30(a), 41(i)(ii) of Bihar Prohibition and Excise Act.

130 liters of liquor is said to have been recovered from the place situated behind the shop of the petitioner and it is alleged that the petitioner was using the place for selling illicit liquor.

The learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and petitioner is in jail since 22.01.2020. Petitioner has no manner of concern with the recovery of liquor. Recovery was made from open place. Considering the facts aforesaid and the fact that the petitioner has already remained in jail for more than 3 1⁄2
