Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bihta P.S. Case No. 858 of 2022 dated 01.09.2022, lodged under Sections 341, 323, 325, 307, 302, 504, 147, 148, 149 of the Indian Penal Code.

As per prosecution case, there were total eight persons who were made accused in the F.I.R. against whom there is allegation to assault the informant and his father, due to which they become badly injured.

Learned counsel for the petitioner submits that for the same date and place of occurrence two F.I.R's. have been lodged, one F.I.R. has been lodged from the informant side and

He further submits that from the contents of F.I.R. it transpires that the manner, time, date and place of occurrence are same. He also submits that petitioner is innocent and has committed no offence. He further submits that from the contents of F.I.R. it transpires that the case is relating to land dispute. Learned counsel for the petitioner further submits that antecedent of petitioner is clean and he is in custody since 16.11.2022. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Danapur, District Patna in connection with Bihta P.S. Case No. 858 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
