JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2019 This is an application for grant of anticipatory bail in connection with Nawanagar (Sonvarsa) P.S. Case No. 168 of 2018 disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Prosecution story is of recovery of 335.160 liters of foreign liquor was recovered from a Pick-up Van bearing No.UP67 AT-1392.

Submission of the learned counsel for the petitioner is that the petitioner is the owner of the vehicle and that vehicle was taken on hire and petitioner has no knowledge about the same. Further submission is that the petitioner has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.12140 of 2019(4) dt.09-05-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.D.J-II-cum-Special Judge, (Excise), Buxar, in connection with Nawanagar (Sonvarsa) P.S. Case No. 168 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to the condition that he has to cooperate in investigation of the case, otherwise the prosecution is at liberty to move for cancellation of his bail bonds and a copy of the same be sent to the Superintendent of Police for the same.
