Punam Devi, wife of deceased gave her fardbeyan on 23.05.2014 disclosing therein that after coming to know about recovery of dead body she rushed and then found the dead body of husband. It has also been disclosed that her husband had proceeded to the place of his Sadhu and during said course, met with one Ashok Yadav and Shailendra Yadav who accompanied him and furthermore, her husband telephonically informed that Bhikhan Yadav, Rukesh Yadav, Siyasharan Yadav (petitioner), Jai Krishan Yadav, Indradeo Yadav, Naresh Yadav along with 6-7 persons shot at him. It has further been disclosed that her father-in-law along with others had gone in search of her husband but could not found. From perusal of the case diary it is apparent that save and except statement of the informant, her mother-in-law, father-in-law that too collecting the information as conveyed by the deceased over mobile, that too omnibus in nature, nothing more remains.
Patna High Court Cr.Misc. No.10180 of 2015 (3) dt.05-05-2015 Accordingly, petitioner Siyasharan Yadav is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Basnahi P.S. Case No.42 of 2014 in the event of his arrest / surrender within four weeks in terms of condition so laid down under Section 438(2) Cr.P.C. (Aditya Kumar Trivedi, J.) PN/- U T
