JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2019 This application, for grant of anticipatory bail, arises out of Makhdumpur P.S. Case No. 347/18, disclosing offences under Sections 341, 323, 324, 325, 326, 307, 504/34 of the Indian Penal Code.

Allegation against the petitioner and others is of assault to the informant and his brother causing injuries to them on back and hand.

Submission of learned counsel for the petitioners is that allegation is not supported by the injury report as no injury has been found either on back or in hand rather the same is found on the head, which is attributed to other accused person of this case.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Jehanabad, in connection with Makhdumpur P.S. Case No. 347/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
