Petitioner is apprehending arrest in connection with Manjhagarh P.S. Case No. 189 of 2019 for the offence under section 406, 420, 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

Allegation against this petitioner is that he has promised to get one shop allotted within ten days in favour of the informant but the petitioner failed to do so. Learned counsel for the petitioner submits that petitioner is neither owner of Janak Super Market situated at Ghosh More, Gopalganj nor the Manager. In fact, he is one of the allottee of the shop. At the relevant time, the informant

Patna High Court CR. MISC. No.9819 of 2020(2) dt.29-02-2020 2/2 took Rs. 3 lakhs from the petitioner. Out of the same three laksh, Rs. 1 lakh was returned to the petitioner through RTGS and now in order to grab remaining two laksh, the present case has been lodged by the informant.

Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Manjhagarh P.S. Case No. 189 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) Ravi/- U T
