Learned counsel for the petitioner undertakes to remove the defects within three weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections419, 471, 420, 467, 468, 120B/34 of the Indian Penal Code. It is submitted by learned counsel for the petitioner that petitioner is innocent and has been falsely implicated in this case. He submits that the name of the petitioner came in the instant case on the basis of confessional statement of co-accused Santu Ram who was arrested by the
Patna High Court CR. MISC. No.12333 of 2022(2) dt.04-08-2022 2/2 police. He submits that alleged articles were recovered from the house of co-accused Santu Ram. There is no recovery from the conscious possession of the petitioner. He further submits that petitioner has one criminal antecedent as stated in para-3 of this application.
Learned APP for the State opposes the prayer for bail and submits that the petitioner is also involved in the case as there is sufficient material available in the case diary. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Shekhopur Sarai P.S. Case No. 140 of 2021. (Anjani Kumar Sharan, J) devendra/- U T
