JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-03-2015 Both the above-said petitions arise out of Cr. Case Com (P) 211 of 2014 arising out of Complaint Case No. 18C of 2014 in which, prima facie case for the offences punishable under Sections-302, 364, 201 of the Indian Penal Code was found and accordingly, both the above-said petitions are being disposed of by this common order.

Heard learned counsels for the petitioners and learned Additional Public Prosecutor for the State as also heard learned counsel, appearing for the complainant.

Patna High Court Cr.Misc. No.9053 of 2015 (2) dt.12-03-2015 2/2 Admittedly, no one has seen the actual killing of the deceased and at best, it is a case of last seen. Petitioners are close relative of the complainant.

Considering the above-said facts and circumstances as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest or surrender in the court below within four weeks from today, the petitioners named-above, shall be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Cr. Case Com (P) 211 of 2014 arising out of Complaint Case No. 18C of 2014 to the satisfaction of Chief Judicial Magistrate, Buxar subject to conditions as laid down u/S 438(2) of the Cr. P.C.
