The petitioner seeks bail in Risiyap P.S. Case No. 62 of 2021, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner along with co-accused Punam Devi pulled down the cousin brother of informant on ground and put lathi on his neck and pressed it against it.

It is submitted on behalf of the petitioner that on account of land dispute between the parties petitioner has falsely been implicated in this case. Alleged injury has been found to be simple in nature. Petitioner claims clean antecedent and he is in custody since 22.11.2021. Investigation is complete. However, counsel for the informant vehemently opposed the prayer for bail and submitted that there is specific

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Risiyap P.S. Case No. 62 of 2021.
