The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 882.200 liters of foreign wine from the orchard of Bananas which belongs to Madan Baith. There is no recovery from the conscious possession of the petitioner. The petitioner has made accused in the same offence in two cases which is mentioned in para-3 of the bail petition.

However, petitioner is agreed to deposit Rs.100,000/- (one lac) in the Juvenile Justice Fund of the State Social Welfare Department.

No.10067 of 2020(2) dt.03-03-2020 2/2 In the aforesaid facts and circumstances of the case, I am inclined to grant anticipatory bail to the above named petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2nd cum Special Judge (Excise), Samastipur, in connection with Musarigharari P.S. Case No. 05 of 2020, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
