JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-06-2017 Heard learned counsel for the petitioner and learned APP representing the State.

The petitioner seeks bail in connection with Buddha Colony P.S. Case No. 35 of 2017 registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code. Allegedly, from the locker of Alankar Auto Sales and Service Pvt. Ltd, Rajapur amount of Rs. 1,47,000/- was stolen away after breaking the locker and from CCTV footage the petitioner has been identified.

Submission is of false implication and that the petitioner is in custody since 02.02.2017, learned court below has given opportunity to the petitioner to renew his prayer of bail after framing of charge, now charges have already been framed, no amount has been recovered from possession of the petitioner and

Patna High Court Cr.Misc. No.17054 of 2017 (4) dt.29-06-2017 as such the petitioner deserves sympathetic consideration. Learned APP opposes the prayer of bail.

In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Ritu Kumari, J. M. Ist Class, Patna in connection with Budha Colony P.S. Case No. 35 of 2017, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
