This application is for grant of bail in connection with Ramnagar P.S.Case No.132 of 2016 for the offence under Sections 394 & 412 of the Indian Penal Code.
It is submitted on behalf of the petitioner that his name transpired in this case as he happens to be brother of Chhote Khan, who is accused in this case and so far identification is concerned, it has been mentioned in Para 114 of the case diary as well as in the impugned order that he has only been identified on the basis of suspicion and nothing else has been assigned to the petitioner and he is in custody for about two months.
Heard learned A.P.P. also.
Having heard both sides. In view of the fact that only he
Patna High Court Cr.Misc. No.9155 of 2017 (2) dt.28-02-2017 2/2 has been identified but nothing has been assigned against the petitioner and coupled with the fact that the petitioner has criminal antecedent, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his prayer for bail before the learned court below itself, after framing of the chare in this case.
Accordingly, this application is dismissed.
