The present petition has been filed for compliance of the order 28.08.2018 in CWJC No.9443 of 2017 and State counsel has submitted the said order was passed in the light of order passed in Birendra Kumar Case (CWJC No.1791 of
Patna High Court MJC No.4847 of 2018(3) dt.23-06-2023 2/2 2008).
He submits that said order was challenged in LPA No.185 of 2018 and the same has been allowed by a Division Bench on 20.04.2023, a copy of which has been provided to the court.
In view of the fact that the order of the writ court on the basis of which the present order was passed has been set aside in LPA No.185 of 2018, no contempt is made out. The petition accordingly stands disposed of with liberty to the petitioner to act in accordance with the liberty granted in the appeal.
