JUSTICE RAJESH KUMAR VERMA ORAL ORDER 02-03-2022 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner seeks bail in connection with Barachatti P.S.Case No.622 of 2020 registered for the offence under Sections 307 and 302 of IPC.

As per FIR, allegation against the petitioner is that he slit the throat of the husband of the informant with knife, due to that he died and it is further alleged that the petitioner stabbed in the abdomen of the informant, due to that he got severely injured.

Learned counsel for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case due to land dispute. He further submits that

Patna High Court CR. MISC. No.21840 of 2021(8) dt.02-03-2022 2/2 as per FIR it is clear that there is land dispute amongst them and story of FIR is full of concocted. Petitioner is in custody since 10.10.2020.

Learned counsel for the informant and learned A.P.P. for the State have vehemently opposed the prayer for bail of the petitioner and submits that the petitioner is grand son of the deceased and grand son of the informant also. He further submits that there is direct allegation against the petitioner. He further submits that during treatment at PMCH, the informant also died.

Considering the aforesaid fact, I am not inclined to enlarge the petitioner on bail in connection with Barachatti P.S.Case No.622 of 2020 pending in the court of learned A.C.J.M., Sherghati, Gaya.

Prayer is refused.
