The petitioner is accused in connection with Balrampur P.S. Case No. 140 of 2015, S.Tr. No. 275 of 2016 registered under Sections 302, 324, 307 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. He was not present at the spot. The specific allegation is against Tapan Kumar Das and Raju Das. The petitioner has no criminal antecedent. Charge has been framed and the petitioner is in custody since 22.08.2016.

Be that as it may, considering the facts and circumstances of the case and from materials available on record,

Patna High Court Cr.Misc. No.4964 of 2017 (3) dt.06-04-2017 2/2 let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Balrampur P.S. Case No. 140 of 2015.
