Petitioner is an accused in connection with Special POCSO - 44/2019 arising out of Sour Bazar (Patarghat O.P.) P.S. Case No. 400 of 2019 for the offence registered under Sections 363, 366(A) and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in connection with the present case. It is further submitted that the victim girl in her statement under Section 164 of the Cr.P.C. stated that the petitioner has not kidnapped her. She has gone with the petitioner in her own sweet will. Petitioner is in custody since 29.09.2019.

Having considered the above facts and circumstances

Patna High Court CR. MISC. No.12538 of 2020(2) dt.04-03-2020 2/2 of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Spl.
