The petitioner seeks bail in connection with Sadar P.S. Case No.25 of 2020, giving rise to Special Excise Case No.30 of 2020, registered under Sections 272 and 273 of the Indian Penal Code besides Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is of recovery of 144 Tetra Pack, each containing 180 ml., and 24 bottles, each containing 750 ml., Indian Made Foreign Liquor, from the Tata Tiago vehicle bearing Registration No.BR 11 AL-0118, of which the petitioner was owner.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.9954 of 2020(2) dt.29-02-2020 2/2 submits that the petitioner has no criminal antecedent and is in custody since 13.01.2020.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge, Excise, Purnea, in connection with Sadar P.S. Case No.25 of 2020, giving rise to Special Excise Case No.30 of 2020.
