JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-02-2016 Heard learned counsels for the petitioner and the State. The petitioner being sister in law (Gotni) of the victim is apprehending arrest in a case registered for the offences punishable under Sections 328 and 302/34 of the Indian Penal Code.

The prosecution case is that the daughter of the informant was administered poison by her husband, husband's brother and petitioner being wife of husband's brother though took the victim to the hospital but she succumbed to the injuries. It is submitted by the learned counsel for the petitioner that on suspicion the accusation has been levelled and from own admission of the informant it appears that the medical assistance

Patna High Court Cr.Misc. No.6350 of 2016 (2) dt.10-02-2016 2/2 was provided by the petitioner, her husband and husband of the victim. The victim died after ten years of marriage having two children. The petitioner claims to be separate from the victim. Considering the suspicious nature of accusation and petitioner being a lady, more over, the impugned order does not suggest any direct material collected against the petitioner, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga in connection with LNMU P.S. Case No. 293 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
