The petitioner is accused in connection with Sessions Trial No. 655 of 2018 arising out of Pipra P.S. Case No. 60 of 2018 registered for the offences punishable under sections 341, 342, 504 and 302/34 of the I.P.C. pending in the Court of Fast Track Court-I, Patna.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in this case. He is in custody since 29.06.2018.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending there is specific allegation of brutally assault by means of lathi on the stomach of the deceased against the petitioner and the

Patna High Court CR. MISC. No.13325 of 2019(3) dt.11-04-2019 2/2 witnesses have also supported the prosecution version. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
