JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-02-2017 The petitioner is in custody since 01.12.2016 in connection with Khagaria Mahila P.S. Case No. 20 of 2015, registered for offences punishable under Sections 498A, 494 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. It has been submitted on behalf of the petitioner that he is ready to keep his wife (opposite party no. 2 ) with full honour and dignity and at present he is also paying maintenance to her and in this case the petitioner has been in judicial custody since 01.12.2016.

Heard learned A.P.P. also.

Having heard both sides, in view of the fact that the petitioner is ready to keep his wife with full honour and dignity

Patna High Court Cr.Misc. No.5748 of 2017 (2) dt.15-02-2017 2/2 and also at present, he is paying her maintenance, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Khagaria, in connection with Khagaria Mahila P.S. Case No. 20 of 2015, subject to the condition that the petitioner shall continue to pay the maintenance to opposite party no. 2 till pendency of the case or till final settlement between the parties.
