ANSHUMAN ORAL ORDER 06-07-2022 Learned counsel for the petitioner submits prior beginning his argument that due to inadvertence Section 414 of IPC could not be typed in the first paragraph and requested to make the appropriate correction in the main petition. Let the prayer is allowed.

Learned counsel for the petitioner is directed to remove the defects in course of the day.

Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sursand P.S. Case No. 07 of 2022 lodged under Section 414 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

As per the allegation made in the F.I.R., total 36 litres

Patna High Court CR. MISC. No.12206 of 2022(2) dt.06-07-2022 2/2 of Nepali wine was recovered on E-Rickshaw. The petitioner was alleged to be the driver of E-Rickshaw.

Learned counsel for the petitioner submits that he is the driver of the E-Rickshaw and passenger was sitting on the E-Rickshaw. He further submits that petitioner is innocent and has committed no offence. Petitioner is in custody since 04.01.2022 having clean antecedent.

Learned A.P.P. has opposed the prayer for bail. In the present facts and circumstances of the case that petitioner is in custody since 04.01.2022 having clean antecedent, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.II, Sitamarhi, Bihar in connection with Sursand P.S. Case No. 07 of 2022, subject to conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
