JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2015 Both the above stated petitions arise out of Saharsa Sadar P.S.Case No. 19 of 2015 registered under section 302, 120B/34 of the Indian Penal Code and accordingly, both the above stated are being disposed of by this common order. Petitioners are named in the first information report with specific allegation that they participated in the alleged crime.
Patna High Court Cr.Misc. No.12618 of 2015 (2) dt.21-05-2015 2/2 Learned counsels appearing for the petitioners submits that the deceased was dreaded criminal and he was killed by some other persons but the informant lodged this false case against the petitioners due to enmity and political rivalry. Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to grant privilege of anticipatory bail to the petitioners and accordingly, their prayer for anticipatory bail in connection Saharsa Sadar P.S.Case No. 19 of 2015, pending in the court of Chief Judicial Magistrate, Saharsa stands rejected.
