The petitioner seeks bail in Nawada (Town) P.S. Case No. 357 of 2016 under Sections 272, 273 of the Indian Penal Code and 47/54 of Bihar Excise Amendment Act, 2016. One Magic vehicle was intercepted from which 200 litres of foreign liquors were recovered.

It is submitted that the petitioner is not named in the F.I.R. The petitioner was arrested in another case and the petitioner is said to have confessed his guilt from which it transpired that the petitioner and one Suraj Kumar were the business partner of the illegal wine which was recovered from the magic vehicle. The petitioner is in jail since 16.1.2017. Considering the aforesaid fact and circumstances, the

No.9974 of 2017 (2) dt.06-03-2017 2/2 above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Nawada (Town) P.S. Case No. 357 of 2016.
