The present writ petition has been filed to direct the District Magistrate, Madhubani to release the vehicle of the petitioner bearing Registration No. BR 7G-1654 (Tata 407), which has been seized and is lying in the premises of Basopatti Police Station in connection with Basopatti Police Station Case No. 193 of 2018.
At the outset, the learned counsel appearing for the State
Patna High Court CR. WJC No.3376 of 2018(5) dt.21-08-2020 2/2 has fairly submitted that the Sub-Divisional Officer, Jainagar by an order dated 18.08.2020 has already released the vehicle in question and the same has also been received by the petitioner. The learned counsel appearing for the petitioner does not dispute the fact that the petitioner has already received the vehicle in question after the same was released by an order dated 18.08.2020 passed by the Sub-Divisional Officer, Jainagar.
At this juncture, it would suffice to state that the order dated 18.08.2020 has been passed by the Sub-Divisional Officer, Jainagar on his own volition and wisdom. Having regard to the fact that the prayer made by the writ petitioner has been rendered infructuous on account of the release of the vehicle, no further direction is required to be issued, hence the present writ petition stands disposed off.
