The petitioners seek bail in Sangrampur P. S. Case no. 96 of 2016 instituted for the offence under Sections 302/34 of the Indian Penal Code.
It is alleged that on 7.8.2016 son of the informant had gone with this petitioners but did not return. On 8.8.2016 informant was informed that dead body of his son was lying in Maya Ganj Hospital. Informant went to the hospital and found the dead body of his son.
Learned A.P.P. after looking into the case diary has submitted that in the case diary the witnesses have merely stated
Patna High Court Cr.Misc. No.8170 of 2017 (3) dt.29-03-2017 2/2 that son of the informant was last seen with these petitioners but no overt act is alleged against them.
In para-3 of the petition it is mentioned that petitioner has no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-2, Munger, in connection with Sangrampur P.S. Case no. 96 of 2016 subject to the conditions that both the bailors will be the close relatives of the petitioners.
