The petitioner is accused in connection with Madanpur P.S. Case No. 89 of 2016, registered under Section 20 of the NDPS Act and Section 47 of the Bihar Excise Amendment Act, 2016, pending in the court of Additional Sessions Judge-I-cum-Special Judge, Aurangabad.
The accusation is that on receiving secret information about carrying of huge quantity of Ganja, police started checking of the vehicles and in that course, one vehicle bearing registration no. OR-14W-0412 was intercepted. On search, 13 packets weighing 108 K.G. of Ganja recovered from the Dickey of Car. At
Patna High Court Cr.Misc. No.8225 of 2017 (2) dt.15-03-2017 that time, the car was being driven by this petitioner and one Santosh Kumar Jaina was found sitting in the car. On query, no paper was produced about the seized Ganja, the petitioner and Santosh Kumar Jaina disclosed that the said Ganja was being carried on the instruction of Ravi Mishra @ Sarang, Subhash and Suresh Sah and the car belongs to Rajesh Sethi. Having considered the facts and circumstances of the case and the recovery of huge quantity of Ganja, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
