Petitioner seeks bail in a case registered for the offences punishable under Sections 406, 420, 34 of the Indian Penal Code.
Allegation against the petitioner is that he was an employee of Saija Finance Pvt. Ltd. The Company in the business of grant of loan and some of the employees were authorized to receive the installment of refund of loan from different consumers. The petitioner and others received rupees Twenty Six Lacs and Odd but did not deposit the same with the Company. Neither the case diary nor any other material show that in fact the petitioner had received from different loanee and did not deposit the same with the Bank. In absence of
Patna High Court CR. MISC. No.12232 of 2019(3) dt.07-05-2019 2/2 documentary support which would be the best evidence of transaction of money, there is no reason to detain the petitioner in custody who is in jail since 30.09.2018 and investigation of the case is already complete.
Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Danapur Patna Police Station Case No.496 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
