JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-08-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Govindpur P.S. Case No. 83 of 2021, registered for the offences punishable under Sections 302, 201, 120(B) of the Indian Penal Code. As per the prosecution case, petitioner along with other co-accused persons named in the FIR in a planned manner committed murder of the brother of informant. It is submitted that there is long standing family dispute between the parties. Five days back earlier to this occurrence, co-accused Dular Yadav had threatened the brother of informant to kill. Petitioner has been made accused in this case only on suspicion. Moreover, informant is not eye-witness to the occurrence. Altogether fourteen persons have been made accused in this case. During course of investigation, no direct or
Patna High Court CR. MISC. No.12271 of 2022(2) dt.16-08-2022 2/2 indirect material has come against the petitioner. Petitioner claims clean antecedent.
Counsel for State however vehemently opposed the prayer for bail and submitted that there is accusation of committing murder of the brother of informant by sharp cutting weapon against this petitioner along with others and concealing the dead body. The anticipatory bail applications of co-accused having similar allegation have been rejected by this Hon'ble Court.
Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioners above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) shashi/- U T
