JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-03-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Case No. 01/2019 (arising out of H.Kharagpur P.S. Case No. 243 of 2018, G.R. No. 2217 of 2018 of 2018 for the offenses under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that occurrence took place on 16.6,.2018. Thereafter the informant was admitted in Jawahar Lal Nehru Hospital, Bhagalpur. The Fardbeyan was recorded on 19.6.2018. Kharagpur P.S. Case No. 243 of 2018 was registered on 1.8.2018. He submits that the aforesaid inordinate unexplained delay in lodging the FIR would indicate that as an afterthought the FIR was registered and this

Considering the fact that the petitioner has no criminal antecedent and he has remained in custody for more than three months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Munger in connection with Sessions Case No. 01/2019 (arising out of H.Kharagpur P.S. Case No. 243 of 2018, G.R. No. 2217 of 2018 of 2018.
