JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------------- 27-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant.

The petitioner seeks bail in connection with Motihari Town P.S. Case No.174 of 2014 registered under Sections 147, 148, 149, 341, 323, 325, 382 and 506 of the Indian Penal Code. The accusation is that the petitioner alongwith his father Umashankar Mishra reached near the informant and one Ram Kumar Singh, who were deputed as Guards by Krishna Kumar to look after his property and assaulted them. Earlier, the petitioner and his father Umashankar Mishra had also made

Patna High Court Cr.Misc. No.15119 of 2017 (2) dt.27-04-2017 2/2 demand of ransom from Krishna Kumar regarding which a case had also been lodged.

Learned counsel appearing on behalf of the petitioner submits that, in fact, there is land dispute in between the petitioner and Krishna Kumar and several civil cases and criminal cases between them are pending. Further submission is that while the present case has been lodged against the petitioner to cause injury to the informant and Ram Kumar Singh but the injuries, as found on their person, are simple in nature caused by hard and blunt substance. The petitioner is in custody since 31.01.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, in connection with Motihari Town P.S. Case No.174 of 2014.
