JUSTICE SUDHIR SINGH ORAL ORDER 04-09-2015 Learned counsel for the petitioners seeks permission to withdraw this application on behalf of petitioner no.2. Permission is accorded.
The present anticipatory bail application made on behalf of petitioner no.2 is dismissed as withdrawn. The petitioner no.1 is apprehending his arrest in Dharhara P.S. Case No.178/14 for the offences under Sections 147, 148, 149, 323, 324, 307, 341, 504 of the I.P.C. and Section 27 of the Arms Act.
Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that one Rabish Kumar who happens to be the younger brother of the informant,
Patna High Court Cr.Misc. No.16465 of 2015 (3) dt.04-09-2015 2/3 had married with Puja Kumari, daughter of the accused, Jai Shankar Yadav two months earlier on account of which all the accused persons variously armed came and accused Alok Raj fired at younger son of the informant causing injury on his right hand. Accused Sabnam Devi and Meena Devi assaulted with iron rod causing injury on the head of the father of the informant. On the order of the petitioner no.1, Lalan Yadav, petitioner no.2, Anand Raj opened fire on the informant causing injury on his forehead. Thereafter all the three injured persons were taken to the hospital for treatment.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that no injury is attributed to the petitioner. The petitioner has been falsely implicated in the present case due to village politics On behalf of the State it is submitted that the petitioner is named in the F.I.R.
Considering the aforementioned facts and circumstances, let the petitioner no.1, named above, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the
