JUSTICE SUDHIR SINGH ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending her arrest in connection with Koilwar P.S. Case No. 47 of 2015 for the offences instituted under Sections 399, 402, 326, 307, 353, 333, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against the petitioner is of making indiscriminate firing from her licency revolver on the police party, as a result of which, one police constable got injured. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is a lady. The petitioner happens to be

There is no allegation against the petitioner for using the arms in course of occurrence. Hence, no offence under section 307 of the Indian Penal Code is made out against the petitioner. On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Koilwar P.S. Case No. 47 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
