JUSTICE SANJAY PRIYA ORAL ORDER 06-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Naya Ramnagar P.S. Case No. 110 of 2016 instituted for the offence under Sections 25(1)a, 25(1-AA), 25(1-AC), 25(1-B)a, 25(1-B)c, 26(i)(ii), 35 of the Arms Act.

It is alleged that informant got information that some miscreants are engaged in manufacturing illegal arms over a mountain in the plastic shade. The informant along with other police official reached there. On seeing the police, the miscreants started fleeing away when some miscreants including the petitioner were apprehended from the spot.

It has been submitted on behalf of the petitioner that co-accused Balkaran Bind with similar

Patna High Court Cr.Misc. No.2274 of 2017 (2) dt.06-02-2017 2/2 accusation has already been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 613 of 2017. From the written report as well as seizure list, it appears that the alleged incriminating articles were seized over the mountain. There is no any seizure of any incriminating articles from the conscious possession of the petitioner. The petitioner is in custody since 04.08.2016. It has been mentioned in para 3 of the petition that petitioner has no criminal antecedent. Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Munger in connection with Naya Ramnagar P.S. Case No. 110 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
