2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 304 ( B ) of IPC . 3 . It is a case of dowry death . The complainant alleged that his daughter was married to co-accused Parmendra Mishra on 20.10.2022 and after marriage , she went to her matrimonial house where these petitioners along with others subjected her to cruelty for dowry and also threatened her to

Patna High Court CR. MISC. No.18819 of 2025(2) dt.18-04-2025 2/3 kill. It is further alleged that on 19.09.2022 , informant got information that all the accused persons including these petitioners killed daughter of informant for non-fulfillment of demand of dowry .

4. Learned counsel for the petitioners submitted that petitioner No. 1 is father-in-law and Petitioner No. 2 is motherin-law and petitioner No. 3 is brother-in -law of the deceased. The are simply victims of over implication . They are separate in mess and property and they have got no concern with the affairs of the couple . As a matter of fact, while deceased was going to attend her skill training at Amir Chand High School Ara , she met with accident and during course of treatment she succumbed to injury and was declared dead. He further submitted that all the family members of the complainant were knowing about the incident and were present at the time funeral but after lapse of 2 and half months, this false and concocted case has been lodged against these petitioners only with a view to extort money .

5 . Learned counsel for the petitioners further orally submitted that thrust of accusation is against the husband of the deceased who is already in custody . Petitioners claim clean antecedent.

6. Learned counsel for the State opposes the bail petition .

7. Considering the aforesaid facts and circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM III Buxar in connection with Complaint Case Case No . 1115 (C) of 2022 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
