JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Complaint Case No. 2183 of 2013, registered under Section 498(A) of the I.P.C.
The petitioner happens to be the husband of opposite party no. 2 and admittedly, the marriage of petitioner was solemnized with opposite party no. 2 in the year 1995 and the present complaint case was filed in the year 2013. It would appear from perusal of paragraph no. 8 of the petition as well as the impugned order that prior to filing of present complaint case, the complainant had filed a complaint case against the petitioner for the occurrence under Section 498(A) and
Patna High Court Cr.Misc. No.11978 of 2015 (2) dt.31-03-2015 2 / 2 other minor Sections of the Indian Penal Code and in the aforesaid case, the petitioner was granted privilege of bail. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest or surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Complaint Case No. 2183 of 2013, subject to condition as laid down under Section 438(2) of the Cr. P.C.
