The petitioner seeks bail in connection with Biraul P.S. Case No.437/16 registered under Section 409/34 of of the Indian Penal Code and 7 of E.C.Act..
The accusation is that while the informant being Block Supply Officer along with Circle Officer was going to Fair Price Shop of Sudhansu Kumar Rai in village Dhakhjari, in the way one pick up van bearing Registration No.BR-06G-7596 was searched. On search 80 bags wheat weighing 40 quintals were seized and the petitioner who was driving the Pick up Van, disclosed that the said wheat bags were loaded at the Fair Price Shop of Sudhansu Kumar Rai in village- Dhakhjari for unloading at Darbhanga. Thereafter
Patna High Court Cr.Misc. No.11239 of 2017 (2) dt.17-03-2017 2/2 the Fair Price Shop of Sudhansu Kumar Rai was searched but no subsidized foodgrain was found.
Learned counsel for the petitioner submits that the vehicle of the petitioner was hired by Sudhansu Kumar Rai to carry the bags of the grain from his house for Darbhanga and he has no concern with the loaded wheat bags. It is further submitted that the petitioner has no criminal antecedent and he is in custody since 31.12.2016.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Biraul, Darbhanga, in connection with Biraul P.S.Case No.437/16.
