The petitioners pray for bail in a case registered for the offence under Section 30(a)(d), 37(c) of Bihar Prohibition and Excise Act.

Total 20 liters of country-made Mahua liquor has been recovered from respective house of the petitioners. It is submitted on behalf of petitioners that nothing has been recovered from the conscious possession of the petitioners. Recovery has been made from the houses, which are in joint possession of the family. Petitioners claim clean antecedent and are in custody since 18.01.2022.

Patna High Court CR. MISC. No.11724 of 2022(2) dt.29-04-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, clean antecedent and period of custody, the bail petition of petitioners is allowed.
