JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 The petitioner seeks regular bail in connection with Sahebpur Kamal P.S. Case No. 11 of 2019, registered for offences punishable under Sections 399, 402 of the Indian Penal Code, Sections 37(B)/37(C ) of Bihar Prohibition and Excise Act, 2016 and Section 25(1-B)A, 26/35 of the Arms Act.

Prosecution story as per F.I.R is that the police on secret information that some persons have assemble to commit a crime has raided the place and found six persons and on seeing the police, they tried to flee away but five out of six were apprehended and one of them succeeded in fleeing away and on search one country made pistol, live cartridges and cell phones were recovered from the possession of co-accused Narad Yadav and from possession of Dharmendra Kumar one country made pistol and 356 ML liquor was recovered and from the possession of

It has been submitted on behalf of the petitioner that from the F.I.R. itself it is evident that no recovery has been made from the possession of the petitioner and he has no criminal antecedent and has falsely been roped in the present case and he has been in judicial custody since 08.01.2019 Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge cum Special Judge, Excise Act, Begusarai, in connection with Sahebpur Kamal P.S. Case No. 11 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
