====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-02-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Nadi P.S. Case No. 5 of 2019 for the offence under Section 30 (a) of Bihar Prohibition and Excise Act 2016. Learned counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent. He further submits that in the instant case total 200 liter of country made liquor was seized from the tempo. Learned counsel for the petitioner next contended that nothing was recovered from the possession of the petitioner. He submits that petitioner is neither driver nor owner of the vehicle or the liquor and only on suspicion he has been apprehended by the police. He submits that petitioner is in custody since 05.01.2019.

Case No. 5 of 2019.
