Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

It is alleged that the inverter, battery and stabilizer were stolen from the hotel of the informant. The suspicion was raised against the petitioner, since the petitioner was loading something on the Auto Rickshaw on the alleged date of occurrence.

It is submitted by the learned counsel for the petitioner that merely suspicion has been raised, since the petitioner has a bicycle repair shop, adjacent to the shop of the informant. Statement has been made in para-3 of the petition

Patna High Court Cr.Misc. No.10922 of 2015 (2) dt.17-03-2015 that petitioner has no criminal antecedent.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with M.M.C.H. P.S. Case No. 03 of 2015, pending in the court of learned Additional Chief Judicial Magistrate, Gaya.

With this observation this application is disposed of.
