The petitioner seeks bail in connection with Araria (R.S.) P.S. Case No. 998 of 2019, registered under Section 414 of the Indian Penal Code.

The accusation is that in course of patrolling, one person was seen moving in fast speed boarding on motorcycle, when signal was given to stop the motorcycle that person started to flee away, but, he was apprehended with the motorcycle, who disclosed his name Soeb. On query, he did not give any satisfactory reply and produce any paper regarding the motorcycle.

Submission is that in fact, motorcycle was recovered near Hero Honda show room situated at Raniganj Bus Stand, but, the petitioner, who was passing nearby the Bus Stand was

Patna High Court CR. MISC. No.10209 of 2020(2) dt.02-03-2020 2/2 apprehended by the police mere on suspicion. The petitioner has no criminal antecedent and is in custody since 16.11.2019. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Araria (R.S.) P.S. Case No. 998 of 2019 to the satisfaction of the Chief Judicial Magistrate, Araria, subject to the condition that out of two bailors, one must either be parent or close relative of the petitioner.
