JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-07-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks bail in connection with Dariyapur P.S. Case No. 230 of 2018 registered for the offences punishable under Sections 396 of the Indian Penal Code and 27 of the Arms Act.

At the very outset, learned counsel of the petitioner submits that due to typing error at Paragraph No. 11 of the petition, the date of custody has been written as 18.01.2019 in place of 6.11.2018.

In view of the aforesaid submission let the date of custody at Paragraph 11 of the petition be read as 6.11.2018.

Petitioner is not named in the First Information Report but in course of investigation three prosecution witnesses

Patna High Court CR. MISC. No.12930 of 2020(3) dt.09-07-2020 2/2 vide Paragraph No. 26, 27 and 28 claimed to have seen the petitioner and others committing the alleged crime. Petitioner does have criminal antecedents of near about 10 cases of serious nature, which is evident from perusal of Paragraph No. 3 of the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to extend the privilege of bail to petitioner and, accordingly, his prayer for bail stands rejected. (Hemant Kumar Srivastava, J) GAURAV S./- U T
