JUSTICE SANJAY PRIYA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections-30, 32, 37, 38(i) of the Bihar Excise (Amendment) Act, 2016.

It has been submitted that the petitioner was loading the foreign liquor on the Tata Sumo on the road side at Harnichak. He was apprehended by the police on the spot. It has been mentioned at Paragraph-3 of the petition that he has got no criminal antecedent and he is languishing in judicial custody since 09-12-2016.

Considering the above-said facts and circumstances of the case, let the petitioner named above, be released on bail on

Patna High Court Cr.Misc. No.3757 of 2017 (2) dt.13-02-2017 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Beur P.S. Case No. 303 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Patna subject to condition that both the bailors will be close relatives of the petitioner.
