JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-02-2016 Learned counsel for the petitioner is permitted to make necessary correction in the petition.

Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 354, 504 and 341 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.

The prosecution case is that the informant went to the house of the petitioner to demand his wages on which he was abused and assaulted and when the mother of the informant came to rescue, she was also assaulted.

No.6671 of 2016 (2) dt.12-02-2016 2/2 It is submitted by learned counsel for the petitioners that for the occurrence of 28.12.2015, the FIR was registered on 31.12.2015 which reached to the learned court below on 02.01.2016 which suggests that by antedating the FIR was registered. In the background of wages dispute, the accusation has been levelled when none received any injury. The occurrence took place in the house of the petitioner which cannot be treated to be place of public view. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the delayed lodging of the case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sheohar in connection with Sheohar SC/ST P.S. Case No. 36 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
