2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 363, 365, 366, 366(A)/34 of the Indian Penal Code.
3. As per prosecution case, allegation against the petitioner along with other co-accused persons is of abduction of daughter of the informant and his neighbour with intention to marriage.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. From perusal of impugned order, it appears that the both the victims were recovered out of which one of the victim stated in her statement recorded u/s 164
Patna High Court CR. MISC. No.16431 of 2024(2) dt.12-03-2024 2/2 of the Cr.P.C. that the co-accused Sibi kumar forcibly solemnized marriage with another victim and made physical relationship. She has not specifically stated against this petitioner in respect of any commission of wrong. Only general and omnibus allegation leveled against this petitioner. It is further submitted that the petitioner is languishing in judicial custody since 19.8.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Pandarak P.S. Case No. 101 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM 1st Barh.
