2. The present petition has been preferred for the following relief(s):

"for quashing the order dated 07.06.2016 passed by the Additional Collector Cum Arbitrator, Kaimur (Bhabua) in Misc. Case no. 18/2013-14 by which he has dismissed the petition of the petitioner by which he has prayed to treat the land of the petitioner as commercial by issuance of writ in the nature of certiorari as well as for issuance of writ in the nature of mandamus or any other writ or writs or direction or directions to the respondents to treat

Learned counsel for the petitioner submits that in the case of CWJC No. 20462 of 2016 (Sudarshan Thakur Vs The National Highways Authority And Ors.), the State has filed counter-affidavit, according to which, they have revived the matter for an amended award and in that background, the Sudarshan Thakur (supra) has been disposed of.

4. The submission is that though no counter-affidavit is there, this case is similar to the one disposed of earlier.

5. In that background, this Court allows the petitioner to agitate the matter before the appropriate authority, if the same has not been taken to its logical conclusion till date. Needless to add, the respondents shall be taking the matter to its logical conclusion at an earliest.

6. The writ petition stands disposed of with the aforesaid observation.
